These Terms & Conditions ("Terms") govern your use of the website www.impressionsbykristi.com and the photography services provided by Impressions by Kristi ("we," "us," or "our"). By using our site, contacting us, or booking a session, you agree to these Terms. If you do not agree, please do not use the site or book a session.

Where we agree something specific with you in writing for your session, that agreement controls over these Terms for that session.

Bookings and payment

• Sessions are booked through our inquiry form, by phone, email, or text, and are confirmed once payment is received.
• Full payment is due at the time of booking to secure your date and time. A session is not confirmed until payment is complete.
• Prices, package contents, and any travel fees are confirmed with you before booking. A date is held only once payment is received.
• Weddings, destination sessions, and year-pass packages are arranged personally with Kristi.

Rescheduling and cancellations

Life happens. If you need to reschedule or cancel, contact us as early as you can and we will do our best to find a new date. Reschedules and any refunds are handled personally and are subject to availability and the terms discussed at booking.

If you are running late, please tell us as soon as you can. We will use the time remaining in your booked slot, since a later session may be scheduled after yours. If you do not attend and do not contact us, the session is treated as used.

If we ever have to reschedule, we will offer you the earliest alternative dates we have. If we cannot deliver a session you have paid for and no alternative date works, we will refund it.

Weather and outdoor sessions

We photograph outdoors in Duluth and along the North Shore, where conditions change quickly. Light rain, cloud, cold, and snow are often beautiful, and we will usually shoot through them. If conditions are genuinely unsafe or unworkable, either of us may call it, and we will reschedule to the next date that works for both of us. Rescheduling for weather does not incur a fee.

Location and travel

Sessions take place at our studio, at a location we agree with you, or at a place you choose. If your location is beyond our standard service area, a travel fee may apply; it is quoted and agreed before booking, never added afterward. You are responsible for telling us about any permit, entry fee, or private-property permission your chosen location requires, and for arranging it.

Text messaging (SMS) terms

By providing your mobile number and opting in, you agree to receive text messages from Impressions by Kristi related to your inquiry and booking, and, where you have agreed, occasional promotional messages. You must be 18 years of age or older to opt in to our text messaging program.

• Age restriction: you must be 18 years or older to consent to receive text messages from us. Our SMS program is not directed to anyone under 18. If the person we are photographing is a minor, a parent or legal guardian provides their own mobile number and their own consent.
• Message frequency varies.
• Message and data rates may apply depending on your mobile carrier and plan.
• Reply STOP at any time to opt out. Reply HELP for help.
• Carriers are not liable for delayed or undelivered messages.
• Consent to receive texts is not a condition of purchasing any goods or services.

Photography and image rights

• We retain copyright in all images we create. You receive a personal-use license to the delivered images as described in your package.
• Your personal-use license lets you print, share, and post your images for personal purposes. It does not include commercial use, resale, or licensing to others. If you need commercial use, ask us and we will arrange it.
• Please do not edit, crop, filter, or apply your own retouching to delivered images before sharing them. The edit is part of the work. A credit to Impressions by Kristi when you post is always appreciated, never required.
• With your permission, we may use selected images for our portfolio, website, and marketing. Let us know if you prefer we do not.
• You can change your mind about public use at any time, and we will remove images from the places we control.
• Unedited files, raw files, and outtakes are not delivered. The selection and edit are part of the service.
• We do not license your images to stock libraries or third parties, and we do not provide them for training artificial-intelligence or machine-learning systems.

During your session

• You are responsible for the safety and supervision of children and anyone else you bring, particularly near water, cliffs, roads, and uneven ground on the North Shore.
• Please treat locations and any props or equipment with care. You are responsible for damage caused by you or your group.
• We may end a session early, without refund, if anyone behaves in a way that is unsafe, abusive, or unlawful. This is here for safety and has never been needed.
• Please tell us in advance about anything that affects the session, including accessibility needs, allergies, or a person who should not be photographed.

Galleries and delivery

Edited galleries are typically delivered within about two weeks of your session. Timelines may vary during busy seasons; we will keep you informed.

Galleries are hosted online for the period described in your package or stated in your gallery. They are not a permanent archive: please download and back up your images promptly. We keep our own copies as a courtesy but cannot guarantee a file will be available years later.

Prints and products

Prints and physical products are produced by professional labs. Colors can vary slightly between screens and print media, and between print runs. Products are made to order, so they are not returnable except where they arrive damaged or the order was fulfilled incorrectly. Tell us promptly and we will put it right. Specific product options, pricing, and turnaround are confirmed with you at the time of order.

Events outside our control

Neither of us is responsible for failing to perform because of events beyond reasonable control, including severe weather, illness, injury, bereavement, road closures, power or network failure, equipment failure, or government restrictions. If that happens we will reschedule. If no alternative date works, we will refund amounts paid for the services we could not deliver.

Limitation of liability

To the fullest extent permitted by law, our liability for any claim relating to our services is limited to the amount you paid for the session. We are not liable for indirect or incidental damages.

In the unlikely event of equipment failure, data loss, or another circumstance that prevents delivery of some or all images, our responsibility is limited to refunding the amount paid, or reshooting where that is practical and you prefer it. We carry professional equipment and back up files, but we cannot guarantee against every failure.

Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your use of delivered images beyond your license, or the conduct of anyone you bring to a session.

Use of this website

All content on this website, including photographs, text, and design, belongs to Impressions by Kristi or is used with permission, and may not be copied or reused without our written permission. Please do not attempt to disrupt the site, access it by automated means, or use it for any unlawful purpose. The site is provided "as is," and while we work to keep it accurate and available, we do not guarantee it will be error-free or uninterrupted.

Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

If something goes wrong, please contact us first: nearly everything is resolved with a conversation. If a dispute cannot be resolved that way, it will be brought in the state or federal courts located in St. Louis County, Minnesota, and both of us consent to the jurisdiction of those courts.

General terms

• Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver: if we do not enforce a term on one occasion, we have not given up the right to enforce it later.
• Entire agreement: these Terms, together with anything we agree with you in writing for your session, are the whole agreement between us.
• Changes: we may update these Terms; the "Last updated" date at the top will change. The version in effect when you book governs that session.
