Privacy Policy

Impressions by Kristi ("we," "us," or "our") operates the website www.impressionsbykristi.com and provides portrait photography services in Duluth, Minnesota and along the North Shore. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. By using our site or contacting us, you agree to the practices described here.

Information we collect
- Contact details you give us through our inquiry form, our website chat, or by email, phone, or text: your name, email address, phone number, and the session details you share.
- Booking and payment information needed to schedule and confirm a session. Payments are processed by our payment provider; we never see or store full card numbers.
- Location details for outdoor and on-location sessions (an address or place name) so we can plan travel and arrive prepared.
- Session information you choose to share so we can plan well, such as who is attending, the occasion, and any accessibility or scheduling needs.
- Photographs created during your session, which include images of you and anyone you bring. See Photographs and your likeness.
- Communications between us, including messages sent through our website chat, email, and text, which are stored in our customer-relationship platform.
- Limited technical information such as your general device type and the pages or buttons you interact with on our forms and chat. See Cookies and similar technologies.
How we collect it
- Directly from you, when you submit our inquiry form, use the chat on our site, email, call, or text us, or talk with us in person.
- Automatically, in a limited way, through the form and chat tools embedded on our site.
- During your session, in the form of the photographs we create.
Cookies and similar technologies
We want to be specific here rather than generic. Our website does not run Google Analytics, advertising pixels, or third-party marketing trackers. We do not use cookies to build advertising profiles, and we do not sell or share information for cross-context behavioral advertising.
What our site does load:
- Our inquiry form and chat widget, provided by HighLevel / LeadConnector. These set cookies or similar identifiers needed to make the form and chat work, and they record interactions with those tools (for example, that a form was opened or a message was sent) so that your inquiry reaches us.
- Web fonts served by Google Fonts. Loading a font causes your browser to contact Google's servers, which receives your IP address as part of that request.
- Images and assets served from our providers' content delivery networks.
Most browsers let you block or delete cookies in their settings. Blocking them may stop our inquiry form or chat from working properly. Because we do not perform cross-site tracking, we do not respond differently to browser "Do Not Track" signals.
How we use your information
- To respond to inquiries and communicate with you about your session.
- To schedule, confirm, and deliver photography services, including appointment reminders, preparation details, and follow-up.
- To process payments and keep records of bookings.
- To deliver your gallery and any prints or products you order.
- To send booking-related and, with your separate consent, occasional promotional messages you can opt out of at any time.
- To keep business records, resolve disputes, and meet legal, tax, and accounting obligations.
- To improve our services and, where you have agreed, to show selected images in our portfolio and marketing.
SMS / text messaging
If you provide your mobile number and opt in, we may send you text messages related to your inquiry and booking: appointment scheduling and reminders, session preparation details, and, where you have agreed, occasional promotional offers. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for help. Consent to receive text messages is not a condition of purchasing any goods or services.
We collect this consent through a separate, optional checkbox that is never pre-checked and is never bundled with any other agreement. Booking-related texts and promotional texts are collected as two distinct consents, so you may agree to one without the other.
You must be 18 years of age or older to opt in to our text messaging program. Our SMS program is not directed to anyone under 18. Where the person being photographed is a minor, a parent or legal guardian provides their own mobile number and their own consent.
No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties, and all of the categories of sharing described elsewhere in this policy exclude that opt-in data and consent.
How we share information
We do not sell your personal information. We share it only with the service providers that help us run our business, and only as needed to provide our services. These are the categories, and what each one handles:
- Customer-relationship and messaging platform (HighLevel / LeadConnector) — stores your contact record and conversation history, and sends our email and text messages.
- Payment processor — completes transactions. Card details go directly to them.
- Online gallery platform — hosts your finished images for viewing, downloading, and ordering.
- Website hosting and content delivery — serves this website.
- Print labs and product fulfillment — when you order a physical product, we share what is needed to produce and ship it.
- Professional advisors such as accountants, where needed to run the business.
These providers are permitted to use your information only to perform services for us. We may also disclose information if required by law, subpoena, or other legal process, or where we believe disclosure is necessary to protect our rights or the safety of others. If our business is ever sold or transferred, client records may transfer as part of it, and this policy would continue to apply until you are told otherwise.
As stated above, SMS opt-in data and consent are never shared with third parties for their own marketing.
Photographs and your likeness
Photographs are personal, so we treat them separately from other information.
- You control whether we show your images publicly. We may ask to use selected images from your session in our portfolio, on this website, in social media, or in marketing. Tell us at any time if you would prefer we did not, and we will not. If images are already published when you ask, we will remove them from the places we control within a reasonable time.
- Sessions involving children require permission from a parent or legal guardian before any image is used publicly, and that permission can be withdrawn at any time.
- On-location and off-site sessions may take place in public or semi-public places where other people are present. We photograph our clients, not bystanders, and we do not publish recognizable images of people who are not part of the session without their permission.
- We do not sell your images, and we do not license them to stock libraries or to third parties for their own advertising.
- We do not provide your images to third parties for use in training artificial-intelligence or machine-learning systems, and we do not do so ourselves.
- Copyright in the photographs remains with Impressions by Kristi; what you receive is a license to use your images as described in your package. See our Terms & Conditions.
How we protect information
We use reasonable administrative and technical safeguards to protect the information we hold, including password-protected accounts, encrypted connections for this website and our galleries, and limiting access to the people and providers who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach ever affects your personal information, we will notify you as required by law.
Data retention
We keep your information for as long as needed to provide our services, maintain business records, and meet legal obligations. In practice that means contact and booking records are kept for as long as our business relationship continues and for a period afterward for tax and accounting purposes. Photographs and galleries are kept for the period described in your package or gallery; galleries are not intended to be permanent archives, so please download and back up your images. You may ask us to delete your information, subject to records we are required to keep.
Your choices and rights
- Texts: opt out any time by replying STOP. Reply HELP for help.
- Marketing email: use the unsubscribe link in any marketing message.
- Access, correction, or deletion: ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it.
- Image use: ask us not to use your images publicly, or to stop using them, at any time.
To exercise any of these, contact us using the details at the bottom of this page. We will respond within the time required by applicable law, and we will not treat you differently for making a request.
State privacy rights
Some U.S. states give residents specific privacy rights. Depending on where you live, these may include the right to know what personal information we collect and how we use it, the right to request a copy, the right to request correction or deletion, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising a right.
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes that require a right to limit. To make a request, contact us using the details below; we may need to verify your identity before we act on it, and an authorized agent may make a request on your behalf with proof of authorization.
Visitors outside the United States
We are based in Minnesota and our services are offered to people in the United States. If you contact us from outside the U.S., your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country. By contacting us, you understand that your information will be handled as described in this policy.
Children's privacy
Our services are directed to adults. We do not knowingly collect personal information from children under 13 through this website, except details a parent or guardian provides when booking a family or child session, and photographs created during a session a parent or guardian has arranged. A parent or guardian may review, request deletion of, or refuse further collection of their child's information by contacting us.
Links to other sites
Our website links to other places, including our social media pages and our online gallery platform. Those services have their own privacy policies, and this policy does not cover what they do with your information.
Changes to this policy
We may update this policy as our business or the law changes. When we do, we will revise the "Last updated" date at the top of this page. If a change is significant, we will make reasonable efforts to tell you directly. Continuing to use our site or services after an update means you accept the revised policy.
